Service Agreement

This Service Agreement (the "Agreement") is made and entered into by and between Silvia Isachsen Enterprise Inc. ("Company," "we," "our," or "us") and any individual or entity ("Client," "you," or "your") who accesses or purchases our online coaching, digital courses, instant downloads, memberships, and related services (the "Services"). By purchasing, accessing, or using our Services through our website and the Kajabi platform, you agree to be bound by the terms of this Agreement.

1. SERVICES PROVIDED

Silvia Isachsen Enterprise Inc. offers digital products and services, including but not limited to:

  • Online coaching
  • Digital courses
  • Instant downloads
  • Memberships
  • Webinars
  • Masterclasses
  • Online services such as funnel creation, video editing, digital assets auditing, and copywriting
  • Other related digital services

All Services are provided on an "as-is" basis without any guarantees of success or specific outcomes.

2. PAYMENT AND REFUND POLICY

2.1 Fees and Payments

All fees for Services must be paid in full at the time of purchase. Prices are listed in U.S. dollars (USD) unless otherwise stated. Payments are processed through our website and/or the Kajabi platform using secure third-party payment processors.

2.2 Payment Plans

For select higher-priced Services, we may offer payment plans at our discretion. If a payment plan is offered, you agree to complete all scheduled payments in full. No refunds will be provided on Services purchased through a payment plan under any circumstances. Failure to make a scheduled payment may result in suspension or termination of access to the purchased Service.

Automatic Payment Authorization: By selecting a payment plan, you authorize us to charge your payment method on the agreed-upon schedule. If a payment is declined, your access may be revoked immediately.

2.3 Refund Policy

  • No Refunds: All purchases of coaching, instant downloads, memberships, and related services are final and non-refundable.
  • Digital Course Refund Policy: If you are not 100% satisfied with a digital course, you may request a refund within seven (7) days of purchase by emailing [email protected]. Refunds will be processed within 7-10 business days. After this period, no refunds will be granted under any circumstances.

3. DISCLAIMERS, WARRANTIES, AND LIABILITY LIMITATIONS

3.1 No Guarantees

The Company does not guarantee any particular result, success, or outcome from the use of our Services. Results will vary for each individual and are dependent on multiple factors beyond our control. Any statements made in writing, verbally, or in video regarding potential results, earnings, or success stories are not guarantees but are examples based on personal experiences or shared testimonials from past clients or students. These examples do not promise, imply, or ensure that you will achieve similar results. The Company does not guarantee any particular result, success, or outcome from the use of our Services. Results will vary for each individual and are dependent on multiple factors beyond our control.

3.2 No Professional Advice

Our Services do not constitute financial, legal, medical, psychological, or other professional advice. It is your responsibility to seek independent professional guidance where appropriate.

3.3 No Warranties

To the fullest extent permitted by law, our Services are provided "as-is" and "as available," without any warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

3.4 Limitation of Liability

To the fullest extent permitted by law, Silvia Isachsen Enterprise Inc. shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising out of or related to the use or inability to use our Services, even if advised of the possibility of such damages. In no event shall Silvia Isachsen Enterprise Inc.'s total liability to you exceed the amount you paid for the service in question.

3.5 Assumption of Risk

By using our Services, you acknowledge and accept that any decisions you make based on the information provided are made at your own risk. We are not responsible for your well-being before, during, or after the purchase or consumption of our Services.

3.6 Emotional and Mental Well-being Disclaimer

Our Services are not intended as therapy, counseling, or medical treatment. You acknowledge that participation in our Services is voluntary, and we are not responsible for any emotional or psychological distress you may experience.

3.7 Personal Liability Protection

You acknowledge that Silvia Isachsen Enterprise Inc. is a separate legal entity, and by agreeing to these terms, you waive any right to hold Silvia Isachsen personally liable for any claims, damages, or losses related to your use of the Services.

3.8 Release of Claims

By purchasing, accessing, or using our Services, you release and discharge Silvia Isachsen Enterprise Inc. from any and all claims, liabilities, damages, or legal actions arising from your participation.

4. CONFIDENTIALITY & NON-DISCLOSURE

All coaching, consulting, and service-based sessions are confidential. You agree not to share, disclose, or reproduce any proprietary information provided to you during our engagement.

5. GOVERNING LAW AND DISPUTE RESOLUTION

5.1 Jurisdiction

This Agreement shall be governed by and construed in accordance with the laws of the Province of British Columbia, Canada, and applicable federal laws of Canada. If you reside outside of Canada, you agree that any legal disputes shall be resolved exclusively in British Columbia.

5.2 Dispute Resolution

Any disputes arising from this Agreement shall first be resolved through good faith negotiations. If a resolution is not reached, disputes shall be submitted to binding arbitration in British Columbia, Canada. If you initiate legal action against Silvia Isachsen Enterprise Inc. and do not prevail, you agree to be responsible for all legal costs, including but not limited to attorney fees and arbitration expenses, incurred by Silvia Isachsen Enterprise Inc. in defending against the claim.

5.3 Class Action Waiver

You agree that any dispute resolution will be conducted on an individual basis and that no claims may be brought as a class action, consolidated, or representative proceeding.

5.4 Non-Disparagement Clause

You agree not to make false, misleading, or defamatory statements about Silvia Isachsen Enterprise Inc., its Services, employees, or representatives in any public forum, including but not limited to social media, online reviews, or third-party platforms.

5.5 Chargeback Waiver

You agree not to initiate chargebacks through your bank or payment processor after purchasing our Services. Any disputes regarding payments must be resolved directly with Silvia Isachsen Enterprise Inc.

6. SEVERABILITY & SURVIVAL

If any provision of this Agreement is found to be unlawful, void, or unenforceable, the remaining provisions shall remain in full force and effect. The provisions related to indemnification, limitation of liability, intellectual property rights, dispute resolution, and any other provisions that by their nature should survive termination shall remain in full force and effect even after termination of this Agreement.

7. MODIFICATIONS TO AGREEMENT

We reserve the right to modify this Agreement at any time. The most current version will be posted on our website. Continued use of our Services constitutes acceptance of any modifications.
